2. Definitions

- Buyer: An individual or entity purchasing digital artwork from ForgeNFT.com.
- License of Use: The rights granted to the buyer for personal and/or commercial use of the digital artwork.
- SCL PRIM SERV S.R.L.: The legal entity operating ForgeNFT.com.
3. Purchasing Digital Artworks
3.1 Unique Ownership
Each piece of digital artwork sold on ForgeNFT.com is a one-of-a-kind masterpiece. Once sold, it will never be offered for sale again, ensuring its exclusivity.
3.2 Finality of Purchase
- All purchases are final upon confirmation of payment.
- Digital artworks are non-refundable, non-exchangeable, and non-cancelable due to their intangible nature.
- Refund Disclaimer: Due to the intangible and downloadable nature of digital art, all sales are final. Refunds, cancellations, or exchanges are not permitted under any circumstances.
- Buyers must acknowledge and agree to the following before completing their purchase:
“By purchasing this artwork, I understand that the sale is final, and I waive my right to request a refund or exchange under Romanian and EU digital goods laws.”
3.3 Buyer Responsibility
- Buyers are responsible for providing accurate contact and billing information during the purchase process.
- Buyers must ensure the secure storage of their downloaded digital artwork. ForgeNFT.com is not liable for lost or deleted files after successful delivery.
4. Intellectual Property Rights
4.1 Transfer of Rights
Upon purchasing a digital artwork, the buyer is granted the following rights:
- Personal Use: Buyers may display or share the artwork in personal settings or on personal media platforms.
- Commercial Use: Buyers may reproduce, modify, or incorporate the artwork into commercial projects, products, or services.
- Exclusive File Ownership: The original digital file remains exclusive to the buyer, but ForgeNFT.com retains a copy for archival and promotional purposes.
4.2 Retained Rights by ForgeNFT.com
ForgeNFT.com retains the non-exclusive right to use the sold artwork for:
- Display in marketing materials or promotional campaigns.
- Portfolio purposes, showcasing the artwork as part of ForgeNFT.com’s collection.
4.3 Limitations of Use
Buyers agree not to:
- Use the artwork in a manner that violates applicable laws or regulations.
- Associate the artwork with hate speech, violence, or discrimination.
- Claim personal authorship of the original creation.
4.4 Fair Use by Buyer
Buyers agree to respect the integrity of the artwork and not use it in a manner that:
- Promotes illegal activities, hate speech, violence, or discrimination.
- Misrepresents ForgeNFT.com or damages its reputation.
- Impersonates or misattributes authorship of the artwork.
5. Delivery of Artwork
5.1 File Delivery
Upon successful purchase, buyers will receive a high-resolution digital file of the artwork via a download link or email.
5.2 No Physical Product
ForgeNFT.com only provides digital files; no physical prints or materials are included in the purchase.
5.3 Responsibility for Access
Once delivered, it is the buyer’s responsibility to download and securely store the purchased artwork. ForgeNFT.com provides a download link valid for 30 days from purchase. After this period, ForgeNFT.com is not responsible for reissuing the file.
6. Liability
6.1 Limitation of Liability
ForgeNFT.com and SCL PRIM SERV S.R.L. are not responsible for:
- Losses due to buyer misuse of the artwork.
- Corruption or deletion of the digital file after delivery.
- Unauthorized use or sharing of the artwork by the buyer.
6.2 Indemnification
Buyers agree to indemnify and hold ForgeNFT.com harmless from any claims, damages, or liabilities arising from misuse or unauthorized use of the artwork.
7. Dispute Resolution
7.1 Governing Law
These Terms are governed by the laws of Romania.
7.2 Dispute Process
Any disputes shall first be resolved amicably. If no resolution is reached, disputes will be settled in accordance with Romanian legal procedures.
8. Amendments
ForgeNFT.com reserves the right to update these Terms at any time. Significant updates to these Terms will be communicated to buyers via email or a prominent notification on the ForgeNFT.com website. Buyers are encouraged to review the Terms periodically to stay informed.
